The U.S. Supreme Court has permitted Texas to enforce a law that mandates app stores verify user ages and secure parental consent for minors seeking to download applications. This decision, made on July 6, allows the state to proceed with the enforcement of the law while a legal dispute is ongoing.
The legislation, referred to as Senate Bill 2420, requires operators of app stores like Apple and Google to confirm the ages of users in Texas. Additionally, it stipulates that parental or guardian consent is necessary for individuals under 18 to download apps or make in-app purchases. App developers are also required to indicate the suitability of their products for specific age groups: those under 13, ages 13 to 15, ages 16 and 17, and those 18 and older.
Texas Attorney General Ken Paxton, who supports the law, described the Supreme Court's decision as a win for online child protection. However, the law has faced opposition from the Computer and Communications Industry Association and Students Engaged in Advancing Texas, who argue it infringes on First Amendment rights. The 5th U.S. Circuit Court of Appeals is set to review the law's constitutionality in early August, following a previous federal ruling that had blocked it.
The Supreme Court's order does not address the constitutional issues at stake, leaving open the possibility for further appeals after the 5th Circuit's ruling.
