County to vote on 93 more Sunset Ranch lots east of Preston Road; a plat note ties a street rule to the builder's lawsuit

Grayson County commissioners will be asked Tuesday to approve the next section of Sunset Ranch, a subdivision in the county's Precinct 1 east of Preston Road near Marilee Road.

The final plat for Sunset Ranch Phase 2B shows 93 residential lots and two common-area lots on about 18.1 acres, along with a little over half an acre set aside for Block Road right-of-way. The item is on the agenda for the Commissioners Court meeting at 10 a.m. Oct. 13.

The county's Development Services staff wrote in the agenda request that the preliminary plat for Sunset Ranch was approved Oct. 10, 2023, that the engineering plans have been reviewed and approved, and that all requirements for final approval have been met.

Who maintains what

According to the notes on the plat, prepared by Kimley-Horn for owner and developer GRBK Edgewood LLC of Plano:

  • Roads inside the section will be maintained by the Sunset Ranch Municipal Utility District, not the county, except for the area dedicated along Block Road.
  • Mustang Special Utility District will provide and own the water and sewer lines.
  • Grayson-Collin Electric will supply power.
  • A homeowners association, Sunset Ranch Residential Community, Inc., has been formed, and every lot owner must belong to it. The group has the power to levy assessments.
  • Deeds must notify buyers that the streets are public, that the MUD is responsible for them, and that their condition can affect access for emergency vehicles.
  • No lots may be sold until the plat is approved and recorded.

The plat also places the property outside the 0.2% annual chance floodplain on FEMA's flood map.

The lawsuit

One plat note stands out. It says the developer's duty to comply with Section 4.4.3 of the Grayson County Subdivision Regulations depends on the final outcome, after all appeals, of GRBK Edgewood LLC v. Grayson County, Grayson County Commissioners Court, et al., Cause No. CV-25-1128 in the 397th District Court.

If the judgment is reversed or changed on appeal, the note says, the developer's obligations will be adjusted to match.

In the version of the regulations posted on the county's website, approved by commissioners in September 2023, Section 4.4.3 requires subdivisions with lots smaller than 1 acre to build concrete streets inside the development and along the full frontage of any existing county road. The Phase 2B lots average well under that size, with about 13.2 net acres split among 93 homesites.

The agenda materials do not describe the lawsuit or its current status, and the plat note does not say which side has prevailed so far.
